Communalism of the Judiciary dangerous for democracy


Rihai Manch came out with a White Paper on Judicial Communalism and a set of ten propositions at its latest convention.

On the third anniversary of advocate Shahid Azmi's martyrdom, Rihai Manch organised a convention on the communalism of judiciary and terrorism in the democracy in India, which holds Muslims responsible for any acts of terror carried out anywhere in the country, regardless of evidences and the police not following protocol in its investigations.
The threat of growing fascism in systems in the country is dangerous for the democracy.
The seminar started with a condemnation of the Delhi Police Special Cell forcefully detaining the keynote speaker journalist Iftikhar Gilani in Delhi and preventing him from attending the gathering.
Human rights activist Himanshu Kumar, addressed the audience saying the judiciary too had joined hands with the legislature and the executive to oppress the poor and the helpless and people of the country need to mobilise their efforts into movements to be able to bring about a change in this system.
Renowned journalist Prashant Tandon spoke about the 'media trial' of innocent youths by the press which is accountable to no one yet influences judicial decisions heavily. He added that the media is aided by the State in its judicial fascism. He said that the development of a collective consciousness of the public which does not protest impartial investigations and subsequent hanging and bogus encounters of its fellow citizens is a sign of India's transition from a democracy to a fascist nation.


Shahid Azmi's brother Khalid Azmi said that the cause his brother died for is alive in the whole nation and his sacrifice was not for naught.


Gulbarga's Ayaz Al Sheikh called for a strong political movement for a secular judiciary and true democracy, and said that the current system that takes away the right to life of its citizens is in grave need of a haul.  



APCR leader Akhlaq Ahmed said the a majority of the judiciary officials share Sangh Parivar's communal mindset of oppressing minorities and they are hold Manu's ideas as their supreme constitution.

Lawyer and human rights leader from Gujarat, Bilal Kaghzi, who was imprisoned on false charges pointed out that in most trials of terrorist cases, the judges grill the accused and not the opposition which is, in itself a mockery of democratic processes in the country and a violation of judicial principles.   





A 10-point resolution was passed at the conference:
1. Afzal being executed despite an unfair trial is an undemocratic event, a dangerous political move in the nation.

2. Rihai Manch opposes the illegal house arrest of Dr. SAR Geelani in Kashmir and detention of journalist Iftikhar Geelani who wanted to attend this meeting today but was caught and detained in Delhi.

3. The conference was to express concern over the communal nature of the judiciary while ruling in terrorism-related lawsuits and appeals and concludes hoping it would render justice impartially to aggrieved parties and honorable judges will be mindful of constitutional propriety.

 4. The Conference demands that the judiciary reconsider a retrial in terrorism cases which earlier has partial trials and facts be submitted to judicial panels.

5.  Special fast track courts to hear the cases related to terrorism be set-up.

6. RD Nimesh commission report should be made public immediately and authorities guilty of torture should be brought to book.

7. Confession in cases involving terrorism, including provisions relating to confession before the police officer should be cancelled and repealed.

8. Case against defendants sued without the approval of either the President or the Governor be taken back immediately and legal action be taken against officials involved in them.

9. Indian Government bring out a White Paper on Indian Mujahideen.

10. A report on the conduct of civil prisoners exonerated after long should be taken from the prison police and not from the civil police.

Detention of Journalist Geelani a Fascist Measure

Rihai Manch condemns the illegal detention of journalist Iftikhar Gilani and Delhi University Professor SAR Geelani by the Delhi Special Cell. The statement added that it is apparent from the illegal act that the State Police views every Kashmiri as a terrorist even when they've been acquitted by the country's highest judicial body.
Rihai Manch spokesperson Shahnawaz Alam and Rajeev Yadav said that the way two known people were abducted from outside their homes and detained throws light on the reality of how common Kashmiris in are treated in the Valley.
They demanded the State government clarify the reason for this treatment meted out to the exonerated gentlemen. They added that in theory the Special Cell is accountable to the judiciary but in effect it has joined hands with the Sangh Pariwar, which is known for its anti-Kashmiri rants, and acts at their behest.
Rihai Manch called the Afzal Guru killing a political ploy to silence the BJP and snatch its communal vote bank from them in the run up to the 2014 general elections. The duo went on to say that the Congress, in its determination to win the General elections by hook or by crook would leave no stone unturned and would again resort to terror politics and wont hesitate to blast bombs and accuse innocent youth.

Shahid Azmi, who had a taste of Indian justice early on in life, spent numerous years in jail for no fault of his in a bogus case the IB implicate him in. HE studied law during his years in jail and later spent his life fighting for justice for innocent youths. He carried on till his three years ago, on 11th February he was murdered by the intelligence agency nexus.
Looking into his murder has revealed the heinous face of communal-criminal police-intelligence agency politics that has targeted specific minorities in the country. What has entailed is a series of attacks on the legal counsels giving advice to the implicated youth. The Judiciary chooses to ignore the fault lines and make the situation worse. A section of the administration, judiciary and the executive have consciously decided to remain answerable to communal intelligence units and saffron warmongers instead of the Constitution.
Following the fake Batla House encounter officials shamelessly said that an enquiry could not be launched into the matter as the police's morale and credibility would get affected and it never cares to take notice of the torture on Muslim youth by the democratic system. This might be because the system, like the khaki knicker-clad, consider Urdu a language of the terrorist.
Repeatedly proven involvement of political outfits and intelligence agencies in terror incidents has made it obligatory to bring judges appointed by these parties in the docks.
The SP government came to power on its false electoral promises but it has, instead, been busy taking out its criminal members out of confinement since it came to power, leaving innocents in the jail to rot.

The lower courts have been ever more communal, believing the police's made up accounts and going to the extent of granting capital punishment, destroying countless homes and lives.
The Supreme Court, on the other hand has acquitted the same accused persons numerous times, and a majority of the terror suspects lack funds to approach the Apex court,
Today, India faces a Fascist judicial crisis, which is proving to be more harmful than electoral Fascism and non-electoral politics. The judicial ideology of making the courthouse a house of injustice has only helped dole out judicial injustice.

Rihai Manch (Forum for Release of Innocent Muslims Imprisoned in the name of Terrorism) has termed the recent property attachment order against Azamgarh terror suspect Mirza Shadab Beg as the betrayal of Samajwadi Party government's promise to release innocent youths implicated in fabricated terror plans.
Rihai Manch Vice President Zaid Ahmad Faruqi said the Gorakhpur blast has been blamed on Tariq and Khalid, whose innocence in the Court premises blast case has been proven by the RD Nimesh Report which the government is suppressing from public scrutiny.
The report explains how the ATF, with help from intelligence agencies tortured innocent Khalid and Tariq into accepting blame for the Court blast case. He expressed doubts on the governments claims to solve terror cases and at the same time not making the Nimesh report public and carrying the legacy of the previous government forward.
Rihai Manch demanded the Samajwadi Party government fulfill the promises it made during its election campaign and withdraw its request to seize Shahdab Beg's property.

Praveen Togadia at Damoh

Famous for his incendiary speeches, Vishva Hindu Parishad's International working president Praveen Tagodia, addressing a huge crowd in Damoh, Madhya Pradesh claimed if he becomes the Prime Minister of India, he'll take away the voting rights of Muslims.
The gathering was organised to raise funds to save the Hindu religion.
At a press conference that followed, Togadia said he would force Muslims out of constitutional offices of Police and Administrative forces and political representation in the capacity of Chief Ministers and other posts.
He added he would do this on the second day of prime-ministership.
He also commented opposing the granting of self-employment schemes to Muslims.
