Forum for Release of Imprisoned Innocent “terrorists” convened a conference on the communal mind-set of intelligence agencies in Lucknow on 19th September at the Press Club.
They accused Samajwadi Party (SP) leaders of using communal tactics to get rid of their tainted image following unraveling of reports of scams in the region. CPI leader Atul Anjan reiterated the view saying that the SP resorts to communalism to say in power. He said that the SP needs to wake up to the fact that they can’t divide the State subjects on these lines anymore as the downtrodden with their own sufferings will not play into such politics.

They demand that SP fulfills their promise of looking into the cases of falsely-implicated imprisoned youth and award them appropriate compensation or they’d be forced to protest against the government. They pointed out that the Saudi Arabian government has repeatedly stated that the charges on Fasih Mohammad are unfounded, yet the Congress government has not refrained from branding him a terrorist.
The wrongful conviction and sentencing of Afzal Guru is justified in this country. Muslim boys are picked up and labeled as Indian Mujahideen members and the politics in the country is thoroughly communalized, totally linked to international politics with the Indian government taking decisions at America and Israel’s behest.
Ujjain Advocate Noor Muhammad who is a counsel for imprisoned innocent youth was attacked by Hindu right-wingers recently. He said that no Muslim in this country feels safe and that he was attacked before the very eyes of the Police and in front the Court. He said that Muslims will continue to be attacked if they ask for their rights.
Advocate Muhammad Shuaib said that the five riots in the past six months are a proof that the state government is trying to divert attention from the release of imprisoned persons, reinforcing their communal agenda.

Syed Mubarak, a native of Sitapur, UP, who was held by the state police for two years spoke about his torture during the imprisonment and shared the reason why the police had nabbed him. It was because he was fair and fall, he was labelled a Kashmiri migrant and jailed.
Masihuddin Sanjari said it should be investigated as to which corporate groups benefit from Intelligence Bureau's communalism and whose interests it serves.
Reporter Abu Jafar said injustice in the Batla House case will be grounds for injustice for rulings in future cases.

On the eve of the fourth anniversary of fake Batla House encounter protests will include one against the communalism of Congress, SP and intelligence agencies


Lucknow, 18 September, Batla House fake encounter case should be judicially inquired into as the killings had a political motive.
A candlelight march was attended by hundreds of intellectuals condemning continued arrests of innocent boys in the name of terrorism. They demanded the Batla House encounter be investigated into and held SP accountable for the delay and for not raising the issue in Parliament and the Congress for sleeping over the issue. The demonstraters marched from the GPO, Hazratganj to Gandhi Statue. Leaflets distributed during the event invited the public to a Press Club event the following day to commiserate on the 4th anniversary of the Batla House fake encounter. 

 The protesters included Prof. Ramesh Dikshit, Muhammad Shuaib, Siddharth Kalhans, Tahira Hasan, Ajay Singh, Rajesh Kumar, Randhir Singh Suman, Rakesh, KK Vats, Mahendra Singh, Renu Mishra, Kiran Singh, Hamida, Dr Surwat Gupta, Sudha, Seema Rizvi, Apoorva, Ghazala, Tariq Shafiq, enamel, Hina Kausar, Dr Neeraj, Anjani Gopal, Dr Rastogi, Azharuddin Ansari, Gufran Siddiqi, Bhante Krunashil, Sheila, Laxman Prasad, Shahnawaz Alam, Avinash Chanchal, Rajeev Yadav and Sandeep Pandey amond others.

“The families of ten innocent Muslims who lost their lives and over 30 people who were injured in the Gopalgarh firing  last year still await justice,” said Jamaat-e-Islami Hind state Chief, Engineer Khurshid Hussain adressing the state office in a meeting of Jamaat officials. The meeting reviewed the situation in the state.
Hussain said that the guilty officers who were suspended have been freed and are on duty now due to absence of a charge sheet and even after a year the CBI has failed to produce one.
The government transferred 17 of the police personnel and it’s only willing to give a mild punishment. One of the Congress leaders in the region pressurized the Police to cancel the transfer orders. Mr. Hussain condoned the fact that the state government gave in to the pressure tactics.
He appealed to the administration and the CBI for a speedy unbiased investigation of the case, independent of political pressures and awarding severe punishment to all the officers involved and to release the arrested innocent persons seeking withdrawal of the charges against them.


JTSA releases report on acquittals

The Jamia Teachers’ Solidarity Association released Framed, Damned, Acquitted: Dossiers of a very ‘Special’ Cell. The report was released by Justice Rajender Sachar. The book conslidates accounts of 16 cases of framing and acquittal of innocent Muslim boys, picked up as young as 17 years old. The event had two such falsely charged youth who were released after spending 14 years of their life inside prison cells, going to various trials in different cities to defend themselves against the false charges whilst their family members ran around looking for lawyers but in vain.
The program started with Prof. M. S Bhat, departmentof Economics, Jamia Millia Islamia and President for the JTSA addressing the gathering and giving a sense of how the reports should be taken constructively and objectively and as an aid for providing social entitlements to Indian nationals and should not be seen as anti-governmental.  
Sanghamitra Misra, member of the JTSA and now affiliated with Delhi University gave a brief on the report and pointed out how promotions in the Special cell surpassed those in other departments of the Police and Special Cell officers were awarded with President's Medals et al. for extra-judicial custodies and murders and tampering of evidence and demanded that the state be held accountable for the framing of false charges against boys who are subsequently released, precious years of their lives lost.
Next to speak was Justice Sachar. He congratulated the JTSA on the the hard work they'd put in it their fact-finding research and said such work should be used as building blocks to fight against the inequalities in the society. He quoted the famous like of a German scholar,

First they came for the communists,
and I didn't speak out because I wasn't a communist.
Then they came for the socialists,
and I didn't speak out because I wasn't a socialist.
Then they came for the trade unionists,
and I didn't speak out because I wasn't a trade unionist.
Then they came for me,
and there was no one left to speak for me.
commenting that such biases can only be found collectively and that the injustices levelled against members of minorities should not be taken lightly by others. He called for active participation of Indian citizens to share the burden of being alert and aware and use the tools in the constitution to do so. He also talked about the Treason Act 1860 in the Indian Constitution and how it reflected colonial intolerance of the State and needed disbanding for a healthy democracy.
Advocate N. D. Pancholi spoke about domocracy being the responsibility of all citizens, and in a broader picture, people communing to take care of matters and raise their voices against unreported events and misquoted/misrepresentation of facts by the media and an active participation of the Supreme Court in protecting the Special Cell.
Trideep Pais and Jawahar Raja who have worked closely on the report as indepedent lawyers threw light on the dearth of legal aid for innocents under trial and the loopholes in the implementation of law and a misinterpretation of the constitution to suit government needs.
They signed off with, " Law and justice are too important to be left to the Courts and the Judiciary". Reiterating the need for public involvement and alertness in such cases.
Last to speak was Ms. Roy. She discussed the patterns of Police's modus operandi in such cases and the State's role in creating bogeys to militarize, dehumanise and keep their sujects busy with nerve-rattling reports planted with the help of Special Cell's favored journalists in various news media.
